1. Agreement to Terms

These Terms of Service (“Terms”) form a legally binding contract between you (“User,” “you,” “your”) and xAutomations.io (“xAutomations,” “Company,” “we,” “us,” or “our”) covering all access to and use of:

  • The websites located at xautomations.io, any associated sub-domains, and related content (collectively, the “Site”);
  • Any software, web applications, APIs, browser extensions, mobile apps, or plug-ins we operate, including but not limited to Real-Estate Video Engine, Statusly, and future tools (collectively, the “Platform”);
  • Our digital products and services, such as e-books, templates, design assets, consulting, support, and any other offerings made available now or in the future (together with the Site and Platform, the “Services”).

By accessing or using any part of the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.

2. Eligibility

  1. Age. You must be at least the age of majority in your jurisdiction (18 in most countries) to create an account or use the Services.
  2. Authority. If you are acting on behalf of a company or other legal entity, you represent that you have authority to bind that entity; “you” will then refer to that entity.

3. Account Registration & Security

You may need an account to access certain features. You agree to (a) provide accurate, current information, (b) maintain the security of your login credentials, (c) promptly update any changes, and (d) notify us immediately of any unauthorised use. You are responsible for all activities that occur under your account.

4. Plans, Credits & Billing

4.1 Free Trials & Promotional Credits

We may offer free trials, one-time promotional codes, or usage-based “credits.” Limitations (e.g., one per business email) will be stated in the promotion. Credits are personal, non-transferable, and may expire as indicated.

4.2 Paid Plans

We offer one-off purchases, credit bundles, and recurring subscription plans (each a “Plan”). Plan details, pricing, and any usage limits are described on the checkout page or order form.

4.3 Payment

All fees are payable in the currency displayed at checkout and are exclusive of applicable taxes. Payments are processed by third-party providers (e.g., Stripe, Gumroad). By purchasing, you authorise the provider to charge your chosen payment method.

4.4 Automatic Renewal

Unless stated otherwise, subscription Plans renew automatically at the then-current rate until cancelled. You can cancel at any time in your dashboard; access continues until the end of the paid term.

4.5 Refunds

Refund eligibility is governed by our separate Refund Policy, incorporated by reference.

5. User Content & Conduct

5.1 Your Content

“User Content” means any text, images, data, files, or other materials you submit or upload. You retain ownership of User Content. You grant xAutomations a worldwide, non-exclusive, royalty-free licence to host, process, display, and reproduce User Content solely to operate, improve, and provide the Services.

5.2 Prohibited Content & Activities

You must not:

  • Violate any law or third-party right;
  • Upload anything defamatory, obscene, or infringing;
  • Transmit malware, spam, or automated scripts;
  • Reverse-engineer, decompile, or interfere with the Platform;
  • Use the Services to train or improve competing AI models;
  • Circumvent usage limits, security features, or payment requirements.

We may suspend or terminate accounts for violations without notice.

6. Intellectual Property

  • Our IP. The Services, including underlying code, designs, documentation, trademarks, and proprietary algorithms, are owned by xAutomations or its licensors and are protected by intellectual-property laws.
  • Output Ownership. Subject to full payment of applicable fees, xAutomations assigns to you any copyright it may own in the final outputs generated for you excluding (a) open-source components and (b) third-party content you provided. We may showcase anonymised samples for portfolio or marketing unless you opt-out via written notice.

7. Copyright & Takedown Procedure

If you believe content hosted by us infringes your copyright, please send a detailed notice to hello@xautomations.io. We will respond, remove, or disable access as required and may terminate repeat infringers.

8. Privacy & Data Processing

By using the Services, you consent to the handling of personal data described in our Privacy Policy.

9. Disclaimers

  1. No Professional Advice. Outputs (e.g., videos, analytics, copy) are provided for informational purposes only and do not constitute legal, financial, health, or professional advice.
  2. AI Limitations. Generated content may contain errors or inaccuracies. You are responsible for reviewing and ensuring compliance with laws and industry regulations.
  3. Service “AS IS”. To the fullest extent permitted by law, the Services are provided “as is” without warranties of any kind, express or implied.

10. Limitation of Liability

To the maximum extent permitted by law, xAutomations and its affiliates shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including lost profits, data, goodwill, or other intangible losses, arising from or relating to the Services. xAutomations’ total liability will not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless xAutomations, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your (a) use of the Services, (b) User Content, or (c) breach of these Terms.

12. Modifications to Terms

We reserve the right to revise these Terms and any referenced policies at any time, with or without prior notice. The most current version will always be posted on the Site and will take effect immediately unless a later effective date is specified. Your continued use of the Services after revisions become effective constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must discontinue use of the Services.

13. Termination

We may terminate or suspend your access immediately for material breach or legal compliance. You may discontinue use at any time. Sections that by nature survive (e.g., IP, disclaimers, liability) will remain in effect.
